Hey there,
You BTW-ed "...did you know that all pictures that you post on Facebook is now their property?"

And that caused me to search through all of Facebook's terms and conditions etc but I could not find any reference to this fact. Where did you find it??
Thanks!

"...are the proprietary property of the Company, its users or its licensors with all rights reserved."

Wouldn't that mean that your personal pictures are your own proprietary property? It seems to read that all contents belong to ANY ONE of the three listed participants.

I am not a lawyer...I will leave that up to "O" ... but as I read through these things...facebook has taken certain rights...

What all this has to do about faith...I do not know...but it has created dialogue!

User Content Posted on the Site

"You are solely responsible for the photos, profiles, messages, notes, text, information, music, video, advertisements, listings, and other content that you upload, publish or display (hereinafter, "post") on or through the Service or the Site, or transmit to or share with other users (collectively the "User Content"). You may not post, transmit, or share User Content on the Site or Service that you did not create or that you do not have permission to post. You understand and agree that the Company may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including without limitation User Content that in the sole judgment of the Company violates this Agreement or the Facebook Code of Conduct, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. You are solely responsible at your sole cost and expense for creating backup copies and replacing any User Content you post or store on the Site or provide to the Company.

When you post User Content to the Site, you authorize and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the User Content on the Site. By posting User Content to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorize sublicenses of the foregoing. You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content."

I looked at the terms posted on Face Book under the heading "User Content Posted on This Site".
That would seem to say that the Company has the right to use your photos, info etc. as long as you subscribe to FaceBook. The confusing part is that although they state that the license you granted them will expire upon termination, they may have also kept a copy of your content which may be used at their own discretion. How does anyone else understand that? I can understand that they may want to use User Content to promote Face Book but the words transferable and sub-license kind of concern me. "O" or any other lawyer who may be reading this; what is the bottom line on this?

Here are a couple of other analyses of their agreement -

http://www.legalandrew.com/2007/07/21/facebook-and-the-law-8-things-to-know/
http://smallprint.netzoo.net/are-facebooks-terms-of-service-fair/

Neither looks promising.

I have other reasons to distrust Facebook, though. Keep in mind how much data they have about people. Consider how much that data would be worth to the right people, and how often web companies change hands or have security breaches.

Microsoft recently bought a stake in Facebook - and they love to collect data.

Just because I'm paranoid doesn't make me wrong. ;)

I'm not here to hijack this, but who cares?

Obviously people post pictures for anyone to see, so what does it matter whose property it is? I mean i can right click and Save As any picture that i want to, any video i want too. I can redistribute as a i please but honestly, who is going to do much about it?

I think people get a little to worked up over this. I'm sure facebook is the least of your concerns if you feel your always being watched. It is not like they are going to steal your identity, or credit card numbers or anything of that sort. Plus if you don't want any incriminating evidence, or your worried by their policies, DON'T USE IT. Simple enough i would say.

My kids will not be allowed to have FaceBook accounts (or the next viral networking site to come along).
It is my wish and prayer that Soul Sanctuary stop encouraging the use of FaceBook to promote it's kids programs. It tells our children that we as a church are unconcerned about the safety of our little ones.

(BTW people, you do have names...use them)

I give room for your opinion, but it is a parent's responsibility as to what they will allow or not allow with their kids. As for me, only two of my kids have phasebook and I do track where they go, what they write and sometimes we have to have a talk.

It is about smart parenting and if you feel that you must not allow your kids this arena, then I applaud you for holding to your convictions.

I do feel this is just another fad, along with blogging that will end in time....

…and ultimately...it is you the parent which must make choices that you feel are best for your child.

And as for the comment about Soul Sanctuary encouraging people to stop using facebook…I personally think that there are more other critical issues that we as a community can rally behind in our city and world…this is one of those personal decisions as far as I am concerned.

That actually is the exact fear, and it's not baseless... that's the data that is on their server, plus much more - they ask for your email passwords to search for friends, and they get your credit card if you do any "gifts". Even if you trust the current operators of Facebook they *will not* be the ones in charge forever. And that data will not go away when they do. As for redistribution - it's one thing for an individual to do it illegally. It is quite another for a corporation to own your family photos.

The reason it's worth discussing is because a lot of people don't think about it - and if we're honest, how many of us actually read the terms of service when we sign up for stuff? And don't even get me started on the 3rd-party applications that people install - you open everything Facebook knows about you to a set of total strangers who wrote a cool widget.

Having that information, people have to make their own choices. I choose not to do the Facebook thing, and I work in the industry. That might tell you something. I'm not particularly passionate about Facebook either way - I just like my friends to have all the info. Facebook marketing is slick and the attraction is strong. I've got one of my staff training next week to write Facebook apps because it's a huge market. Just assume that any information you give to a website like Facebook is no longer private.

Regarding posting "anonymously"... I'm guessing that was aimed at posters who post as "Anonymous", but all the same I have no problem people knowing who I am, I try not to post things that I wouldn't say in person, I just don't have my user id tied to my name for all the above reasons. :) If it makes a difference to anyone, my name is Evan and if you're part of Soul and you saw the Flying Cow Report at Thanksgiving, that was me (not the cow).

Thanks for the openess and transparency! Personally, I was thinking more of people like "Karen" who at least give us a name, eventhough she cannot be tracked back. But since you have been outed........ :)

In my opinion, some people should just not be so bloody dense that they're like 'hey sounds like a good idea to give all my personal information to a website' I have no sympathy for someone who gets themselves into trouble. Why would you enter stuff like that? And dont give me "well is Ebay safe then?" FIGURE IT OUT!

"The reason it's worth discussing is because a lot of people don't think about it - and if we're honest, how many of us actually read the terms of service when we sign up for stuff?"

If people were so worried about it then why not take a glance at the Terms of Service? And if you cannot take the time to warn yourself and read the Terms, then to bad so sad. Why is it that people need to be spoon fed today? Why can't people make their own decisions and deal with their own consequences. There is a reason why those terms are written up, its a LEGAL document. They lay it out plain as day, they warn you. I suggest if you are that worried, READ THE THING!! If you don't and you get screwed over, it's your own fault, and why should it be anyone else's?

I'm not necessarily saying you, Evan, but for people who 1. are to bloody dense to get it or 2. cannot take the time to read the terms of service, why should I care?

How long are we going to have to hear about stories in the news were people failed to inform themselves and then sue and fail miserably because they cannot follow rules they should have known about?

How long are we going to have to cater to people who cannot make a decision, or make a informed choice in their own lives?

Am i being to harsh here? or is it just the reality that some people shouldn't be using a computer if they are too paranoid or have no bloody clue?

I guess we could let the government keep making our decisions for us, SWEET!!!

Seriously... down with the "anonymous" posting. If you want your opinion to be respected and counted, put an identity to it.

Im unsure why there is such fear to putting a name behind your opinions?

Why can't you just say, "Yes, I am a sexist and a racist... I do believe elderly asian women are the worst drivers in the GTA"

It's that simple. Speak your mind. And have your opinion counted.

P.s. The second worst drivers in the GTA are anyone with a Jesus fish on their car (please speed up!!)

P.p.s. The third worst are anyone with a war-amps sticker on their bumper (though if they are missing an arm or a leg I have greater sympathy for their poor driving skills).
